2. Interim Measures of Xiamen Legal Aid
Article 1 According to the Criminal Procedure Law of the People's Republic of China, Law of Advocate of the People's Republic of China and regulations of the Department of Justice on legal aid, the Measures are laid down in the light of the actual situation of Xiamen in order to carry out the legal principle that all are equal before the law and to protect the party in economic difficulty and the party of special case enjoy fair and equal judicial protection.

Article 2 Xiamen Legal Aid Center (hereafter referred to as 'Center') is a special agency set up after being approved by Xiamen People's Government and registered by Judicial Department of Fujian province. It is under the jurisdiction of Xiamen Judicial Bureau and is in charge of organization, coordination, implementation and supervision of Xiamen legal aid.

Article 3 The legal aid in the Measures here refers to the system of reduction of charges, exemption from charges or postponement of charges supplying to the party in economic difficulty or the party of special case when lawyers, notaries public, and legal staff at the grass-roots level provide legal service to them under the organization and coordination of the 'Center'.

Article 4 In addition to the staff members of the 'Center' who should undertake the items of legal aid listed in the Measures here, all the law firms, notary agencies and grass-roots legal service agencies should undertake the obligation of legal aid.

Article 5 The main duties of the 'Center'.

1) To implement the regulations of the nation, province and city concerning legal aid;

2) To accept, examine and approve the legal aid application;

3) To organize, coordinate and supervise the staff members of the 'Center', the lawyers, notaries public and legal staff at the grass-roots level of the city to undertake the legal affairs;

4) To be in charge of the raising, managing and using of the legal aid fund;

5) To be in charge of the publicizing legal aid work, organizing to do research of legal aid, publicizing and exchanging the results of legal aid;

6) To coordinate the legal aid matter with the court, the procuratorate, the public security bureau and the departments concerned;

7) To be in charge of the unified management of legal aid files;

8) To be in charge of other related affairs handed over by Xiamen Judicial Bureau.
